Welcome to Hirocon Pte Ltd (“Hirocon”, “we”, “our” or “us”), a private limited company incorporated in Singapore having its registered address at 277 Orchard Rd, #B2-28, Singapore 238858. All activity of this website including acceptance and fulfilment of paid orders and subscriptions is managed by Hirocon Pte Ltd and its affiliates.
These Terms and Conditions (“Terms”) govern the purchase of contact lenses through our online platform. Please read these Terms carefully before making any purchase. By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Platform or purchase Goods.
- Definitions
In these Terms:
“Carrier” means any person or business contracted by us to carry Goods from us to you, whether all or part of the distance.
“Consumer” means any natural person who, in connection with this agreement, is acting for purposes which are outside his business.
“Platform” means the entire computing hardware and software installation that is or supports Our Website.
“Goods” means any of the Goods we offer for sale on Our Website
“Content” means any material in any form published on Our Website by us or any third party with our consent.
“Material” means Content of any sort posted by you on Our Website
- Eligibility
To place an order with Hirocon, you must be at least 18 years of age and possess a valid credit or debit card. If you are under 18 years old, you may use the Site under adult supervision. In all cases, the adult assumes responsibility for any activity.
- Ordering Process
By placing an order through our Platform, you are offering to purchase Goods subject to these Terms:
- Orders are subject to acceptance and availability.
- We reserve the right to refuse or cancel any order for any reason, including but not limited to Product availability, errors in pricing or product information.
- Once your order is placed, you will receive an email confirmation acknowledging receipt of your order.
- This confirmation does not constitute acceptance of your order.
- Pricing and Payment
- We strive to maintain updated and accurate pricing, but discrepancies may occur. We’ll confirm your order if the price changes.
- We cover banking charges on payments to us. You’re responsible for other currency-related charges.
- Prices include Singapore Good and Service Tax (GST).
- Full payment is required at the time of ordering.
- Accepted payment methods are specified on our Platform.
- Shipping and Delivery
- Deliveries will be made by post / a Carrier instructed by us to the address stipulated in your order
- We will make reasonable efforts to deliver Goods to the address specified in your order within the estimated delivery time provided (3 to 5 working days).
- We are not responsible for delays beyond our control and will inform you promptly if there are any delays.
- Shipping costs are as stated on our Platform and may vary depending on the delivery location and method.
- Goods are sent at our risk until signed for by you or by any other person at the address you have given to us.
- Returns and Refunds
- We accept returns of unopened and undamaged Goods within 3 days of delivery.
- To initiate a return, please contact our customer service team for instructions.
- Refunds will be issued to the original payment method within 5 - 10 days of receipt of the returned Goods.
- Product Use and Safety
- Contact lenses should be used as directed by your eye care professional.
- We are not liable for any injury, damage, or loss resulting from improper use of Goods.
- Limitation of Liability
- To the extent permitted by law, we disclaim all warranties, express or implied, regarding the Goods and our Platform.
- In no event shall we be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Goods or our Platform.
- Governing Law and Jurisdiction
- These Terms shall be governed by and construed in accordance with Singapore law, without regard to its conflict of law principles.
- Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
- Modifications
- We reserve the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on our Platform.
- Your continued use of our Platform following any such changes constitutes your acceptance of the modified Terms.
- Force Majeure
- We shall not be liable to you for any breach, hindrance or delay in the performance of a Contract attributable to any cause beyond our reasonable control, including without limitation:
- Any natural disaster and unavoidable incident
- Actions of third parties (including without limitation hackers, suppliers, governments quasi-governmental, supra-national or local authorities), insurrection, riot, civil commotion, war, hostilities, warlike operations, national emergencies, terrorism, piracy, arrests, restraints or detainments of any competent authority, strikes or combinations or lock-out of workmen
- Epidemic, fire, explosion, storm, flood, drought, weather conditions, earthquake, natural disaster, accident, mechanical breakdown, third party software, failure or problems with public utility supplies (including electrical, telecoms or Internet failure), shortage of or inability to obtain supplies, materials, equipment or transportation (“Event of Force Majeure”), regardless of whether the circumstances in question could have been foreseen.
- Content and Intellectual Property Rights
- We will defend the intellectual property rights in connection with our Goods and Our Website, including copyright in the Content whether provided by us or by any other content provider (including copyright in: text, graphics, logos, icons, images, audio clips, digital downloads, data, and software).
- We also claim copyright in the designs and compilation of all Content of Our Website. Title, ownership rights, and shall remain the sole property of us and / or the other content provider. We will strongly protect those rights in all countries.
- Except as set out below, you may not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the Content, in whole or in part.
- You may not use our name or logos or trademarks or any other Content on any website of yours or that of any other person.
- Subject to the other terms of this agreement, you may download or copy Content only for your own personal use, provided that you maintain all copyright and other notices contained in it. You may not store electronically any significant portion of any Content.
- Advertising on the Site
- We shall use our reasonable endeavors to comply with any relevant regulations relating to the Site published by the Singapore authorities.
- Amendment to the General Business Terms & Conditions
- We reserve the right to amend these Terms & Conditions at any time. All amendments to these Terms & Conditions will be updated under Effective Date at the top of this page. Continued use of the Site will be deemed to constitute acceptance of the new Terms & Conditions.
- Optometrist and Optician Board (OOB) “Code of Professional Conduct and Professional Practice Guidelines”
- Article 4 stated that a preliminary assessment of suitability of contact lenses and advice must be conducted and documented in the patient’s ophthalmic record and shall include the following:
- (a) History of any allergies or systemic disease;
- (b) History of previous contact lens wear;
- (c) Information on occupational and recreational needs and the environment in which the contact lenses will be worn;
- (d) A thorough eye examination that includes slit-lamp examination of the anterior segment, the external eye, assessment of tear film quality and quantity, use of diagnostic stains where necessary and trial fitting of contact lenses when necessary.
- (e) When prescribing or dispensing contact lenses for a patient, the optometrist shall ensure that the contact lenses prescribed/dispensed/fitted with are most appropriate in meeting the needs of the patient and providing optimum vision for the patient’s required use.
